• Please note that late payment fees will be added where applicable. Failure to pay for goods may also result in exclusion from future auctions.
These terms and conditions set out the terms and conditions that apply to sellers, bidders and buyers to whom we list items for sale. Therefore, before you ask us to sell goods or make a quotation for a quotation, please read them carefully, as they will be binding on you when we approve your sales order or make a quotation.
The terms of this contract are interpreted as follows:
1.1"My / Us" to auctioneers Aleksandar Aureli
1.2"You" are the buyer (you can be a Bidder, Buyer or Seller).
1.3"Seller" is the person who has listed the items for sale with the auctioneer and has legitimate and beneficial ownership of the goods listed in the auctions and/or the agent(s) authorized to act on their behalf.
1.4 "Bidder" is an individual who successfully bids for an item at a public or private auction.
1.5 "Auction" means an attempt by the Buyer to purchase a Lot in accordance with these Terms.
1.6"Bidder" refers to any Bidder, whether or not they win.
1.7 "Auction" means a public or private sale where the auctioneer sells goods belonging to the seller to the highest bidder;
1.8 "Buyer's Bonus" refers to a 24% bonus applied, unless otherwise stated, to the lowest price of all lots.
1.9 "Hammer price" means the highest bid accepted by us.
1.10"Goods" refers to items that the Seller puts up for auction (one item or a set or group of items).
1.11 "Lot" means any Goods sold at auction.
1.12 "Business Day" means any day on which our Department and Auctions are open
1.13 "VAT" means value added tax at the [current rate] of the flight price, unless otherwise stated;

Special provisions take precedence under conditions stated or stated in the auction catalog or stated at the auction.
2. Special provisions on bidding and purchase
2.1 If the buyer makes an offer to purchase certain items, the buyer must conclude the contract stating:
(a) their bid is approved as the highest value bid for the lot; after closing the auction for that item;
(b) the value of their bid is at least equal to or greater than the seller's minimum reserve price for the item (if any).
2.2 The buyer can withdraw from the contract for the purchase of an item only if the goods included in the item do not substantially correspond to the information stated in the auction catalog regarding them, and all such issues should be reported to the seller and the auctioneer as soon as possible, and in any case within 10 days from the receipt of the goods.
Alexander Aurelius Auctioneers is not responsible for any misrepresentation of items beyond key and content such as [pair of shoes, toaster, watch]
Buyers or prospective buyers agree that any definition beyond the essential characteristics of the item, including but not limited to age, origin, condition, make and any other description beyond the essential characteristics, shall be their sole opinion. Any plot without a condition guide would not mean that the plot is flawless.
No oral or written description of the item made prior to sale shall be considered a representation of reality beyond the visible and material characteristics of the item.
2.3 Submission of a bid entitles the auctioneer and any buyer to rely on the bid as a legitimate offer to purchase the items in the lot.
2.4 The bidder may inspect the parts. The bidder must email the auctioneer at info@aureliusauctions.co.uk if the bidder wishes to view the items. Buyers must notify the auctioneer at least 24 hours in advance to arrange for items to be displayed. Please note that in the last 24 hours after the end of the auction, the auctioneer cannot guarantee that any item will be displayed. A refundable deposit may be required to allow item viewing at auctioneer's discretion.
2.5 All information relating to an item must be emailed using the inquiry form for each item or by email to info@aureliusauctions.co.uk. Potential bidders must register for the auction to receive detailed information about the item.
3. Conducting the auction
3.1 All items may, unless otherwise stated in the auction catalog, be subject to a minimum reserve price set by the seller, which is binding on all bidders.
3.2 At any time, the auctioneer may reject any bid or reject any bid from any person;
3.3 The auction manager may offer or withhold the reservation price at any time.
3.4 Unless otherwise stated in the auction catalogue, the seller or his agent or auctioneer on his behalf may bid on any item.
3.5 The auctioneer may remove or separate any lot or combine any lot at any time before the hammer falls.
3.6 The auctioneer may declare the winner of the highest bid for any item before the auction closes.
3.7 If a bidder submits a bid within 10 minutes or less of the end of the auction, the auctioneer has the option to immediately extend the bidding period for the item by ten (10) minutes.
3.8 The auctioneer has sole discretion as to whether any bid is successful. The auction manager can decide whether there is a dispute between the bidders, briefly evaluate the dispute to which the final bid refers, or whether the auction has ended and, if so, at what price; or in any case immediately put the item up for sale again, without specifying the purpose.
3.9 The auction manager determines first of all the method of conducting the auction without the need for an explanation.
3.10 The auctioneer reserves the right, at its sole discretion, to reject any bid it deems not to be of fair value.
3.11 We are not responsible for errors on the website, problems with registration / acceptance of offers.
3.12 Item definition should take precedence over photographs. If original photos cannot be included, we reserve the right to use stock/catalog photos. Please be careful when bidding on an item with the image for reference only, as item colors and sizes may vary from the item being sold. No warranty is given.
4. After the sale
4.1 After the Auctioneer announces an auction for any of the Lots in order to close and sell the Lot, the Buyer will immediately make a direct payment to the bank account designated by the Auctioneer (the details of which the Auctioneer will provide to the Buyer).
4.2 Payments will be made in pounds sterling (£) (unless otherwise stated).
4.3 All prices are subject to VAT or other applicable charges, distribution and insurance charges, unless specifically stated by the auctioneer (in the catalog or otherwise).
4.4 The buyer is obliged to pay the following amounts in full to the auction manager by 5:00 p.m. the day after the auction.
(a) the balance of the price payable for the Lot plus applicable VAT (including but not limited to the buyer's premium) and packing and shipping costs; Or
b) if the final price of the item is not determined immediately after the sale is concluded, an estimate of the value of the item in its entirety or part of the item is determined ad hoc by the auction manager, whose decision is final and binding.
(c) accepted payment method: bank transfer required. Other payment methods are not accepted.
4.5 If, in accordance with these provisions, the buyer fails to make any payment due to the auctioneer within the deadline, the buyer should:
e-mail and telephone contact of the auction manager;
Pay in-flight storage costs of £20 per flight per day
Pay interest at 8 per cent above the Bank of England base rate from time to time on the outstanding number. Such interest shall accrue regularly, either before or after judgment, from the due date prior to final payment of the outstanding amount. The seller will charge interest along with the remaining amount.
4.6 We will resell the Lot by public or private auction if the Buyer does not make the required payment, which can be as early as the next working day after the day on which the payment is due. The shortfall (if any) arising from the resale in relation to the original amount, together with a relot/administrative fee equal to 20% of the gross invoice amount due as the buyer's default for the first transaction, will be charged to the buyer's credit card registered with us.
4.7 Some auctions will be for delivery only, in which case:
(A)The auctioneer will email the buyer with a request for payment of packing and shipping costs for the entire order after the auction ends. All customers must pay for delivery by 16:30 two days after the end of the sale in which the goods were purchased. Failure to do so will result in the winning items being redrawed and "no refunds".
(B)Sending fragile items such as televisions, monitors,glasswareetc. will be made through a courier company if the buyer agrees to take responsibility for the shipment in transit.
(c) Standard terms limit liability to a maximum of £100 per shipment insured. Exceptions apply. Shipments of higher value will be fully insured; the cost of insurance will be added to the amount.
(d) The buyer accepts responsibility for loss, damage or theft of a shipment over £100 if the buyer refuses to fully insure the shipment.
(e) In the unlikely event of loss, damage in transit or missing contents, the buyer must notify the auctioneer within 5 days of estimated delivery time for loss claims or 3 days of delivery for damage and theft claims. We will submit a claim to the courier and the buyer will receive a refund if/when the courier company accepts the claim and remits the funds to us.
5. Liability of the auctioneer
5.1 The items sold in each lot are sold as is, with all defects and imperfections and all errors of definition that do not relate to the characteristics of the item, therefore the auctioneer is not responsible for any defects (hidden or not). It is known that bidders are satisfied with the condition of each lot they bid on.
5.2 Alexander Aurelius Auctioneers or its agents make no written or oral warranty for any item, unless expressly stated in the goods summary. Any product images promoting any other warranty are void as defined by the product
5.3 Please note that we do not rate electrical appliances. We may not make any warranty or representation that electrical products are functional. Buyers of electrical or mechanical equipment are advised to have the products tested by a trained electrician or mechanic before use. The auctioneer is not responsible for any damage incurred or caused by the use of these items.
5.4 Neither the seller nor we are responsible for the authenticity of any batch. However, if the buyer wishes to dispute the authenticity of the lot, the following applies:
The buyer must initiate any dispute about the authenticity of the lot by giving written notice that the lot is in his opinion a counterfeit within 14 days of the date of sale.
The Buyer shall return the Lot to us within 28 days of such notification in the same condition as it was at the time of sale, together with documentation (presumed evidence of the Buyer) to satisfy us that the Lot is a counterfeit in light of the catalog entry. The Consumer must still ensure that successful and transferable ownership of the Lot is also transferred without any third party claim against the Lot.
In this situation, the sale of the item will be canceled and the purchase price will be refunded.
Seller and buyer agree to be bound by our decisions. We may seek advice from any expert or other authority before determining whether a batch is counterfeit.
5.5 When registering for an auction, the buyer accepts that the auction sale is not a consumer sale within the meaning of the Consumer Rights Act 2015 under Section 2(6) of the Consumer Rights Act 2015.
6. Data protection
6.1 The Buyer acknowledges and agrees that (in accordance with the Auctioneer's Privacy Policy) the Auctioneer may collect, process and store personal data and feedback relating to the Buyer's transactions with the Auctioneer and share such personal data with Sellers who enter into contract with the Buyer, the auction manager. This is done on an ongoing basis to ensure the integrity and reputation of the Auctioneer and to enable the Auctioneer, Sellers and Buyers to complete a transaction.
7. Registration Guidelines
7.1 The auctioneer reserves the right to refuse bidder registration for bidding without warning or compensation.
7.2 The auctioneer reserves the right to request a deposit from all or some bidders at any time.
7.3 When registering, the bidder must state his full name and surname, initials and nicknames are not valid.
8. General conditions
8.1 We document all our telephone conversations. We reserve the right to use them as facts in case of disagreement.
8.2 All auctions are business transactions and not retail transactions.
8.3 Online auctions are not subject to the Consumer Protection (Distance Selling) Regulations 2000 or the Home and Business Consumer Cancellation Orders 2008. The buyer can only exercise their right to cancel the sale if the goods are considered to be materially different from the description offered. The most up-to-date legal act is the Rulebook on Consumer Contracts from 2013, which replaces all previous regulations.
9. Dispute Resolution, Remedies and Set-off
9.1 In any case, the customer has 10 days to submit a dispute regarding the received goods from the moment of receipt of the item. The buyer can notify the seller and the auctioneer of any problems as soon as possible, and no later than within 10 days of receipt.
9.2 Bidders who submit reversed payments will be charged the following fees:
(a) Administration fee of £250 plus VAT to defend against chargeback.
(b) Storage charges will commence immediately on receipt of notice of chargeback from our bank for a period of 28 days at a rate of £50 per item per day plus VAT. We will continue to try to recover all of our premiums.
(c) All chargebacks will be initiated in court.
9.3 The following fees are borne by the bidder if the auctioneer has to initiate the procedure:
(a) Solicitors' fees range from £150 to £250 plus VAT for bringing proceedings;
(b) Original letter supplied by solicitor: £25 plus VAT; AND
(c) All court fines, including but not limited to lost earnings of £90, travel costs of £165 and legal costs.
(d) Our court attendance rate for solicitors is £300 plus VAT per hour plus costs.
(f) When dealing with a legal claim our staff cost is £70 plus VAT per hour plus expenses.
In general
Any waiver by us of any breach of this agreement shall not be in any form and shall not be construed as a waiver of any further breach of the same or any other clauses.
